Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your access to and use of the website jajovo.com (the "Site") operated by Jajovo Enterprise, Inc. ("Jajovo," "we," "us," "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms do not govern the service agreements Jajovo enters into with paying clients. Paying clients are bound by their separate Service Agreement with Jajovo.

2. Use of the Site

  1. You agree to use the Site for lawful purposes only.
  2. You agree not to attempt to access restricted areas, probe for vulnerabilities, scrape content without permission, or disrupt the Site's operation.
  3. You agree not to submit false, misleading, or impersonating information through any form on the Site.

3. Form Submissions

When you submit a contact form on the Site or on a client website operated by Jajovo:

  1. You represent that the information you submit is accurate and belongs to you.
  2. You consent to being contacted by Jajovo or by the client business the form serves, by the methods and on the terms described in the Privacy Policy and in the consent language on the form.
  3. You understand that initial contact may be conducted by an automated system or artificial intelligence.
  4. You may opt out of further communications at any time as described in the Privacy Policy.

4. Artificial Intelligence and Automated Systems

Certain communications from Jajovo or from our clients are generated or delivered by artificial intelligence, including voice calls, SMS messages, and emails.

  1. AI communications are identified as such on first contact when practical.
  2. AI communications may transcribe, summarize, and store the content of your responses for the purposes described in the Privacy Policy.
  3. You may request to speak with a human at any time, and we will make a reasonable effort to route your request to an appropriate person.
  4. AI systems can make errors. If a response you receive appears inaccurate, incomplete, or inappropriate, contact legal@jajovo.com.

5. Intellectual Property

  1. Jajovo owns the Site, the Jajovo trademarks, the Jajovo logos, and all content we create and publish on the Site, except where otherwise indicated.
  2. You may view and share Site content for personal, non-commercial purposes. You may not reproduce, modify, or redistribute Site content for commercial purposes without written permission.
  3. Client businesses featured on the Site, including case studies and testimonials, retain their own trademarks and are referenced with permission.

6. Disclaimers

  1. The Site and its content are provided "as is" and "as available."
  2. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
  3. We do not warrant that the Site will be uninterrupted, secure, or error-free.
  4. Nothing on the Site constitutes legal, medical, financial, or professional advice.

7. Limitation of Liability

To the maximum extent permitted by law, Jajovo and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site is limited to one hundred dollars.

This limitation does not apply to the extent prohibited by applicable law.

8. Indemnification

You agree to indemnify and hold harmless Jajovo from any claim, demand, or damages arising out of your breach of these Terms, your misuse of the Site, or your violation of applicable law.

9. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.

10. Changes to the Terms

We may update these Terms from time to time. The "Last Updated" date indicates when the Terms were last changed. Continued use of the Site after changes constitutes acceptance of the updated Terms.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to personal jurisdiction in these courts.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Site will first be addressed through good-faith negotiation between the parties. If the dispute is not resolved within sixty days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Maricopa County, Arizona. Judgment on the award may be entered in any court of competent jurisdiction. The parties waive any right to participate in a class action.

13. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
